Terms and Conditions of Sale

Welcome to Pheni. These Terms form a binding agreement between you and Alex Lynn Buntrock, the operator of pheni-us.com, and apply to all visits and purchases. Our Return and Refund Policy, Shipping Policy and Privacy Policy are part of these Terms. Your use of the Site or completion of an order constitutes acceptance.

About Us

Pheni is the trading name of Alex Lynn Buntrock, an individual seller located at 2234 East Oak Street, Phoenix, AZ 85006-2051, United States. We sell women's fashion online through this Site. You can reach us at support@pheni-us.com or the contact form, Monday to Friday, 9:00 AM – 6:00 PM (Mountain Time (MT)).

Age Requirement

Purchases may only be made by persons aged 18 or over who can lawfully enter into contracts. This Site is not intended for children under the age of 13, in line with the Children's Online Privacy Protection Act, and we do not knowingly collect their data. When you place an order you confirm that the information you provide is accurate and that you are authorized to use the chosen payment method.

Pricing

All prices are shown in USD. The price of an item is the price displayed at the time you place your order. Sales tax is calculated at checkout based on the shipping address and shown at checkout. The total shown at checkout — items, shipping and taxes — is the total you pay; we do not add fees afterwards. When we advertise a discount, the reference price is a price we actually charged before the promotion. We correct pricing errors when we find them; if an error affects your order we contact you before shipping with the option to confirm at the correct price or cancel for a full refund.

How Orders Work

Your order is an offer to buy. After checkout you receive an order confirmation email; this acknowledges receipt of your order but does not accept it. A contract of sale is formed when we ship the goods and send the shipping confirmation. We may decline or cancel an order before shipment for reasons including unavailability, a pricing or description error, suspected fraud, or a shipping address we cannot serve; if we do, any payment is refunded in full within 7 business days. We may limit quantities per order or per customer.

Payment Methods and Billing

We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay and Shop Pay. Payments are processed securely by Shopify Payments (powered by Stripe); we do not store full card numbers on our servers. Your card is charged when the order is placed. The charge appears on your statement as PHENI-US.COM. If a charge is declined, or our payment provider's fraud screening flags the order, we may ask you for additional verification or cancel the order. If you believe a charge is incorrect, please contact us before contacting your bank — most issues are resolved within a business day.

Cancellations, Returns and Refunds

Our cancellation and refund terms, in summary: cancel at no cost before the order ships; return eligible items within 90 days of delivery, unused and in original packaging, to 2234 East Oak Street, Phoenix, AZ 85006-2051, United States; return postage is free; refunds go back to the original payment method 5–10 business days after we receive and inspect the item (7 business days for cancellations); faulty or wrong items are always replaced or refunded free of charge. The full Return and Refund Policy, which you accept at checkout, governs in case of any difference.

Shipping and Delivery

We ship to the United States. Orders are processed within 1–2 business days; at checkout you choose Economy Shipping (USD 7.95, 7–14 business days, free on orders of USD 159 or more) or Fast Shipping (USD 24.44, 7–11 business days). Every order includes tracking. If we cannot ship within the promised time we notify you before that date with a revised date and the right to cancel for a full refund; if the delay exceeds 30 days or is indefinite, the order is cancelled and refunded unless you expressly agree to wait. Full details, including our fulfillment locations and how import duties are handled, are in our Shipping Policy, which is part of these Terms.

Liability

To the fullest extent permitted by law, Pheni and its owner are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits or data, arising from your use of the Site or any product, and our total liability for any claim related to an order is limited to the amount you paid for that order. This limitation does not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection statutes. Some jurisdictions do not allow the exclusion of certain damages, so parts of this section may not apply to you.

Warranties and Disclaimer

Products are covered by the 12-month limited warranty against manufacturing defects described in our Return and Refund Policy. To the extent permitted by law, any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the term of that limited warranty. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. The Site itself is provided "as is" and we do not warrant that it will be uninterrupted or error-free.

Intellectual Property

All content on the Site — text, product descriptions, photographs, graphics, logos and the Pheni name — is owned by or licensed to us and is protected by copyright and trademark law. You may view and print pages for personal, non-commercial use only. Reproducing, distributing or using our content for any other purpose without written permission is prohibited. If you believe content on the Site infringes your rights, email support@pheni-us.com with the details and we will respond promptly.

Use of the Site and Customer Reviews

Use the Site lawfully and in good faith: no fraudulent or unauthorized orders, no attempts to breach security, no automated scraping, no abuse of discounts. Reviews on our product pages come from customers who bought the product; we take reasonable steps to verify them and never commission fake reviews. Content you submit must be truthful and yours; you allow us to publish it and we may remove anything inappropriate.

Products and Availability

We make every effort to describe products accurately and to show them as they are. Colors may vary slightly with your screen settings, and dimensions are approximate unless stated as exact. Our products are unbranded, generic items sourced from selected manufacturers; any brand names appearing in descriptions are for compatibility reference only and do not indicate affiliation. Product availability is not guaranteed until an order ships; if an item becomes unavailable we contact you with the options of waiting, a substitute or a full refund. We do not use false scarcity or countdown claims.

Governing Law and Dispute Resolution

These Terms and any purchase are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict-of-law rules, and by the Arizona Consumer Fraud Act, A.R.S. § 44-1521 et seq. where it applies. Please contact us first at support@pheni-us.com: almost every issue is resolved by our support team within a few days. Arbitration agreement. If a dispute cannot be resolved informally within 30 days, you and we agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its consumer rules, rather than in court, except that either party may bring an individual claim in small claims court. Class action waiver: claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase. This section is governed by the Federal Arbitration Act. Nothing in this section prevents you from filing a complaint with the consumer protection office of your state attorney general or with the Federal Trade Commission.

Other Terms

These Terms can change; check the date at the bottom of this page, and remember that each order is governed by the Terms published when it was placed. Should a court hold any clause invalid, the other clauses remain binding. Not enforcing a right today does not mean we give it up. Together with our Return and Refund, Shipping and Privacy Policies, these Terms are the complete agreement between us, replacing any earlier terms. Rights under these Terms are personal to you and not transferable; we may transfer ours if the business is sold.
